Can I grow marijuana in New York with an MMJ card?

Certified New York medical marijuana patients at least 21 can cultivate up to six cannabis plants — three immature and three mature female plants — at their private residence, but only for personal use.

In addition, designated caregivers 21 or older caring for a certified patient can cultivate the same number of mature and immature cannabis for the patient's use. A designated caregiver can grow up to six plants per patient but cannot grow more than 12 plants at any time.

Once trimmed, a certified patient or caregiver can have up to five pounds of cannabis at their residence.

According to the law, a private residence is any building or part of a building or structure designed and occupied for residential purposes, including but not limited to a private home; townhouse; condominium; co-op; apartment; or mobile home.

Hospitals, hotels, motels, resorts, or other public accommodations are not considered private residences for the purposes of cannabis cultivation unless otherwise approved by the state of New York. Cannabis may not be grown in any federally funded or recognized public housing site. Growing cannabis, even for medical purposes, at a federal public housing site could result in your loss of housing support.
